1. Eligibility and Community

Use of the Site is strictly limited to individuals who are members of the USAG Italy community: active-duty military, civilian employees, contractors, or on-post host-nation personnel ("Community Members").
Use by any other person or entity—including businesses, commercial organizations, dealers, service providers, or anyone not listed above—is expressly prohibited.
You represent and warrant that you meet these eligibility requirements.

2. Responsibility: Buyer and Seller Accounts

Sellers create and manage their own listings. They are solely responsible for description accuracy, pricing, delivery arrangements, and fulfilling all sales obligations.
Buyers commit to purchasing any item for which they place a confirmed order. Buyers who fail to complete a purchase may be suspended or removed at the administrators' discretion.

3. No Fees, Commissions, or Subscriptions

The Site is free to use. We do not charge registration fees, commissions, subscriptions, or any other transaction fees.

6. Prohibited and Restricted Items

Sellers must not list or sell any items or offerings that are illegal, unsafe, or violate these Terms. The following are expressly prohibited or restricted:

Animals & Animal Byproducts
Live animals, ivory, fur, or other wildlife-derived products, nor animal byproducts such as eggs, milk, or honey.
Weapons & Explosives
Firearms, ammunition, explosive devices, and weapon accessories.
Controlled Substances
Illegal drugs, drug paraphernalia, or prescription medications.
Stolen or Counterfeit Goods
Any item that infringes intellectual property rights or is known to be stolen.
Explicit Adult Content
Materials depicting sexual acts or intended for adult audiences only.
Hazardous Materials
Radioactive, toxic, or biohazardous substances.
Military Clothing & Gear
Restricted to sales between verified military personnel only. Sellers must confirm the buyer's active military status.
Commercial Entities & Professional Services
Professional shops, car dealerships, manufacturers, or other businesses may not list goods or services.
Services & Digital Goods
Listings are limited to tangible personal property. No services or electronic downloads are permitted.
Other Illicit or Regulated Goods
Any items prohibited by U.S., Italian, or EU law.

7. Home-Baked Goods & Cooked Food Items

Permitted Items
Sellers may list home-baked goods and other prepared food items, provided they comply with all applicable food-safety and hygiene regulations and guidelines.
Ingredients & Allergen Disclosure
Each listing must clearly disclose any common allergens (e.g. nuts, dairy, gluten, soy, eggs, shellfish) or special-diet considerations (e.g. vegan, vegetarian, keto).
Seller Responsibility
Sellers are solely responsible for preparing, storing, and delivering food items in a safe, sanitary manner and for obtaining any required permits or inspections.
No Site-Administrator Liability
The Site's administrators make no warranties—express or implied—regarding the quality, safety, or fitness for consumption of any food items sold. Buyers assume all risk related to purchasing, handling, and consuming home-prepared foods.

8. Seller & Site-Owner Disclaimers

Seller Responsibility
All listings, products, and transactions are the sole responsibility of the Seller. We make no representations or warranties regarding any item's quality, safety, legality, or fitness for purpose.
Site-Owner Disclaimer
We are not responsible for any aspect of a transaction, including item condition, shipping, customs duties, taxes, or disputes between buyers and sellers.

9. Limitation of Liability

To the fullest extent permitted by law, our liability is disclaimed and capped at direct damages up to $1 (one USD).

10. Termination and Suspension

Administrators may suspend or terminate any buyer or seller account at any time, without notice or explanation.

11. Compliance with Laws

Users must comply with all applicable U.S., Italian, and European Union laws, regulations, and military orders governing property, commerce, and import/export controls.

12. Intellectual Property

Sellers grant us a non-exclusive license to display their listings.
You agree not to copy or scrape any content from the Site for unauthorized use.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, liabilities, and expenses arising from your breach of these Terms or any transaction conducted through the Site.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Italy.
Any dispute arising under these Terms shall be resolved by the competent courts in Italy, unless mandatory law requires otherwise.
